Although the controller is established in Andorra, this site directs its services at users resident in the European Union, so processing is carried out in accordance with Regulation (EU) 2016/679 (GDPR). Andorra benefits from an adequacy decision of the European Commission, so processing your data from Andorra is not an international transfer subject to additional safeguards.
2. What data we process, and why
Contact form
- Data: name, email address, telephone (optional) and the content of your message.
- Purpose: to handle and answer your enquiry.
- Legal basis: your consent (Art. 6(1)(a) GDPR), given by ticking the box on the form.
SIEX Checker
The Checker collects two separate consents. The second one is optional and does not affect delivery of your report.
- Data: email address and your answers to the questionnaire (profile, area by crop type, autonomous community and how you currently keep your records).
- Main purpose: to produce and send you your personalised report. Legal basis: your consent, given in the mandatory box on the form.
- Additional, optional purpose: to send you news about SIEX rules and precision agriculture. Legal basis: your consent, given in a separate, voluntary box. If you do not tick it, your address is not added to any marketing list.
You may withdraw either consent at any time by writing to info@orcelis.com, or through the unsubscribe link included in every message, without affecting the lawfulness of processing carried out beforehand.
Browsing this site
- Data: IP address, browser type and pages visited, recorded by the server.
- Purpose: security, incident detection and maintenance of the service.
- Legal basis: legitimate interest in keeping the site secure (Art. 6(1)(f) GDPR).
3. Retention periods
We keep your data only for as long as the purpose that justifies it requires:
- Contact form enquiries: until your enquiry is resolved and, from then on, for five years, the general limitation period for personal claims.
- SIEX Checker data: twelve months from the date you request the report.
- News subscription: until you withdraw your consent or unsubscribe. After that we keep only the minimum data needed to make sure we do not write to you again.
- Consent records: for as long as the consent is in force plus three years, so that we can demonstrate it was given.
- Server logs: twelve months.
Once those periods have elapsed, the data is deleted or irreversibly anonymised.
4. Recipients and processors
We do not sell or disclose your data. To provide the service we use the following suppliers, which act as processors and process your data only on our instructions:
- Raiola Networks, S.L. (Spain) — website hosting.
- Sendinblue SAS, “Brevo” (France) — email delivery and management of subscription lists.
- Proton AG (Switzerland) — mailboxes for the orcelis.com domain. Switzerland benefits from an adequacy decision of the European Commission.
- Google Ireland Limited (Ireland) — site usage analytics, only if you consent to statistical cookies. This service may involve a transfer of data to the United States, covered by the EU-US Data Privacy Framework.
In addition to these processors, your data may be disclosed to courts, tribunals and public authorities where a legal obligation requires it.
5. Your rights
You may exercise your rights of access, rectification, erasure, objection, restriction of processing and portability by writing to info@orcelis.com, stating which right you are exercising and enclosing a document proving your identity. We will reply within one month at the latest.
If you believe the processing does not comply with the rules, you may lodge a complaint with the supervisory authority of your country of residence. If you live in Spain, the competent authority is the Agencia Española de Protección de Datos (www.aepd.es). If you live in Andorra, the Agència Andorrana de Protecció de Dades (www.apda.ad).
